Terms of Use
1. Operator and service
QazDriver (also referred to as QazDrive) is provided by Individual Entrepreneur ADA Technologies, 21 Kultegin Street, Astana, Republic of Kazakhstan; email: dastan_ermaganbet@mail.ru. The entrepreneur identification number will be added once the details are confirmed.
QazDriver lets users publish and find shared-ride offers and passenger requests, discuss parcel delivery, contact each other by phone and record their agreement responses. Under this edition, the service does not receive ride payments, deduct ride commissions or settle payments between users.
2. Users and eligibility
Independent use is limited to adults with legal capacity. Do not create accounts in another person’s name or share access with third parties. Provide your own phone number and accurate information; notify the operator if you lose access.
Drivers must ensure their driving entitlement, lawful vehicle use, required documents, insurance, roadworthiness and compliance with mandatory requirements for the particular transport activity. App approval does not replace government permissions, safety checks or insurance.
3. Listings, contact and search
Provide accurate cities, addresses, dates, request types, seats and prices. Do not publish another person’s personal data without a lawful basis. Driver listings use cities; passenger requests also include pickup and destination addresses.
Lists and notifications do not guarantee a companion, receipt of every new request, a phone call or fulfilment of a trip. Passenger search lasts until the end of the departure date in Astana/Almaty time unless closed or cancelled earlier. The five-minute search display does not automatically cancel a request.
To access a passenger’s phone number, a driver must be approved and have an active listing in the same direction published today in Kazakhstan time. Agreed-trip participants retain access to history contacts subject to service rules.
4. Agreements and payments
Users directly agree the trip, price, payment arrangements, meeting point, luggage, parcel and cancellation conditions. A card price is a user’s offer; no payment is made inside QazDriver.
A driver’s “Agreed” response saves the order for that driver independently of the passenger’s answer. If several drivers respond, the passenger chooses one or states that no agreement was reached. Two explicit confirmations of the selected pair save the trip in the passenger’s history and close search for that passenger request.
Returning from the phone app, a timer or a driver’s tap does not prove a conversation or transport took place. Completing a trip in the app records the assigned driver’s report, not independent verification of payment or service quality.
5. Calls, auto-call and permissions
A driver separately enables auto-call for new matching requests in the open active feed. Price and time rules select call candidates without hiding other orders. The mode can be switched off. Device permissions, carrier charges and iOS confirmation apply separately.
Current functionality does not record conversations or read the address book or call log. Location permission supports address selection following an explicit action; camera or selected-photo access supports uploads chosen by the user. Permissions can be withdrawn in device settings.
6. Safety and prohibited conduct
Fraud, spam, threats, discrimination, unlawful listings or parcels, submitting others’ documents, automated contact harvesting, bypassing restrictions and using another person’s account are prohibited. Do not carry prohibited items or items lacking required conditions or permissions.
Before travelling, check identity, vehicle and agreed conditions. Never share login codes or banking secrets. The app is not an emergency service; contact the appropriate public emergency service when in danger.
7. Responsibility and complaints
Users are responsible for their listings, promises, settlements and conduct during trips. The operator is responsible for its own actions and obligations under applicable law. These terms do not exclude mandatory consumer rights, liability for the operator’s culpable conduct or safety requirements.
Functional descriptions do not determine legal classification. If the actual business model falls within mandatory rules for dispatch services, carriers or another regulated activity, those rules continue to apply regardless of the service name.
Report violations through Support in the menu or the operator’s email. Provide the circumstances, order reference/date and available evidence without payment secrets or unnecessary third-party data. Access may be restricted for violations of the rules or law; contact the operator about restrictions.
8. Account, data and stopping use
Data processing is described separately in the Privacy Policy and draft consent. Device permissions do not replace legally required consent. Declining an optional feature does not authorise other processing purposes.
Account deletion is available in the profile with confirmation. Signing out does not delete the account. Agreed trips and certain facts may remain to the extent and on the grounds described in the policy; deletion does not mean every backup is physically destroyed at the moment of the tap.
9. Versions and governing law
The laws of the Republic of Kazakhstan apply, including mandatory consumer and personal-data protections. Jurisdiction and remedies are determined by law; contacting support does not remove the right to approach a court or competent authority.
Documents show a version and preparation date. Material changes to obligations or processing purposes are not automatically accepted merely because new text was downloaded. Fresh consent or acceptance must be obtained separately when required. This draft does not claim that a user has previously consented.
